Dismiss or Withdraw Document (Motion)

Fed. R. Civ. P.  41(a)

 

A Motion to Dismiss or Withdraw a Document is a pleading filed asking the court to withdraw a previously filed document or pleading.

 

If the original movant is requesting the dismissal or withdrawal, no hearing is required.

 

If the Motion to Dismiss or Withdraw document is filed by another party and is not agreed to by the filer of the original pleading, the motion requires a hearing.
