A motion for summary judgment is a request by either the plaintiff or the defendant requesting the court enter a judgment without a trial because there is no genuine issue as to any material fact.


A summary judgment is given on the basis of pleadings, affidavits, and exhibits presented for the record.


The respondent must file a response and memorandum brief within 21 days after service of the motion and supporting memorandum. The movant may file a reply to the response within 14 days after the response is served.  See Miss. Bankr. L. R. 7056-1(3)(B)
