Only the debtor has exclusive right to file a Disclosure Statement and Plan of Reorganization within the first 120 days after the date of the order for relief under this chapter. See 11 U.S.C. § 1121(a)


Before the 120 day exclusivity period expires the debtor may request additional time to file the disclosure statement and plan by filing a Motion and Notice to Extend Exclusivity.  See Extend/Limit Exclusivity Period.


Upon the expiration of the exclusivity period and provided the debtor has not filed a plan; any party in interest including the debtor may file a plan. 11 U.S.C. § 1121(c)(2)
