Extend / Limit Exclusivity Period (Motion)

11 U.S.C. § 1121(d)

 

 

Generally, only the debtor may file a plan during the first 120 days after filing the voluntary chapter 11 petition, entry of an order converting the case to chapter 11 ("order for relief date"), or entry of an order for relief in an involuntary chapter 11 case.

 

The 120 days is the "Exclusivity Period."  The debtor may request an extension to the Exclusivity Period that is no more than 18 months after the order for relief date.
