Conversion from Chapter 7

Chapter 7 to Chapter 11


The debtor may convert his Chapter 7 to Chapter 11 at any time, provided the case has not been previously converted from chapter 11, 12 or 13.

 

On request of a party in interest and after notice and hearing  the court may convert a case from a Chapter 7 to Chapter 11.

Requirements - Request by Debtor:

 

Filing Fee is due only if the court grants the debtor's request (motion).

Chapter 7 to Chapter 12 by Debtor


A Chapter 7 debtor may request to convert to a case under Chapter 12, at any time. The Court may not convert a case from Chapter 7 to Chapter 12 unless the debtor requests or consents to the conversion.

  Chapter 7 to Chapter 13 by Debtor


 

A Chapter 7 debtor may request to convert to a case under Chapter 13, at any time.  The Court may not convert a case from Chapter 7 to Chapter 13 unless the debtor requests or consents to the conversion.

 

If a plan is not filed with the motion to convert, a plan must be filed within 14 days after conversion.  See Notice to File Chapter 13 Plan  See Fed. R. Bankr. P. 3015(b)
