Certification of Non-Compliance of Filing Payment Advices

Standing Order Regarding Filing of Payment Advices

Certification of Non-Compliance is filed by the Trustee when the debtor fails to file the payment advices pursuant to Standing Order Regarding Filing of Payment Advices Pursuant to 11 U.S.C. 521(a)(1)(B)(iv) and Fed. R. Bankr. P. 1007(b).

 

When the Trustee files a Certification of Non-Compliance and subsequently receives the required pay advices and the debtor or attorney for the debtor files the Certificate of Compliance - Pay Advices, the Trustee must act accordingly to either *withdraw the certification of non-compliance or leave the certification of non-compliance as filed.
