Relinquishment

11 U.S.C. § 722

 

In a chapter 7 proceeding when the creditor, debtor, and case trustee agree to lift the stay and abandon property, the parties may complete and submit local form Agreed Relinquishment of Security and Right to Redeem, Motion to Lift Automatic Stay, and Application for Abandonment for court approval.

 

Relinquishments affecting real property must either contain a legal description or a legal description must be attached as an exhibit to the form.  

 

Relinquishment must be uploaded to the ECF system as a Sua Sponte Order.  [Bankruptcy> Order Upload> Sua Sponte Order Upload]
