Notice of Examination Pursuant to Local Rule 2004-1(a)(2)

A party may initiate an examination and production of documents by notice, if the entity to be examined consents.  The party must file and serve the notice no later then 14 days before the examination date.

Requirements:

 

Notice with Certificate of Service.  The Notice must:

 

  • specify the scope of the examination

 

  • date, time and place of the examination

 

  • describe any documents to be produced

 

  • be served upon the

 

    • debtor

    • debtor’s attorney

    • chapter 7, 11, 12 or 13 trustee as appropriate

    • United States Trustee

    • entity to be examined
