Social Security Number (Official Form 121)

Rev. 12/01/2015

Official Form 121 implements Fed. R. Bank. P. 1007(f), which requires a debtor to submit a verified statement under penalty of perjury that sets out the debtor’s social security number.  In a voluntary case, the debtor shall submit the statement with the petition.  In an involuntary case, the debtor shall submit the statement within 14 days from the order for relief.

The form is necessary because Fed. R. Bank. P. Rule 1005 provides that the caption of the petition includes only the final four digits of the debtor’s Social Security number.

The statement provides the information necessary for the clerk to include the debtor’s full Social Security number on the notice of the meeting of creditors, as required under Fed. R. Bankr. P. 2002(a)(1).

Creditors and all parties to a case receive notice of the full Social Security number on the notice scheduling the meeting of creditors served by the BNC.   Only the last four digits of the social security number will be available on the notice filed with the court.
