Proposed Amendments to Uniform Local Bankruptcy Rules

The judges of the bankruptcy courts for the Northern and Southern Districts of Mississippi have adopted a new local form Chapter 13 plan and have amended certain local bankruptcy rules in response to pending amendments to the Federal Rules of Bankruptcy Procedure.
Under pending amendments to Fed. R. Bankr. P. 3015(c), effective December 1, 2017, debtors will be required to use a new Official Form Chapter 13 Plan unless a Local Form Chapter 13 Plan has been adopted by the district in accordance with new Fed. R. Bankr. P. 3015.1.
The proposed new local Chapter 13 plan and amendments to local bankruptcy rules were published for public comment between May 15 and June 14, 2017. After review of public comments, the judges made certain revisions to the proposed plan and local rules.
On July 7, 2017, the judges submitted the proposed new local form Chapter 13 plan and proposed amendments of local bankruptcy rules to the Fifth Circuit for consideration. On September 28, 2017, the Rules Committee for the Judicial Council of the Fifth Circuit approved the new local Chapter 13 plan and proposed local rule amendments.
