Presumptive Interest Rate for Secured Creditors' Claims Paid in
Installments
For Chapter 13 cases filed on or after March 1, 2009, Judge
Ellington, and Judge Olack have agreed to a new presumptive rate of
7%, as outlined in a February 13, 2009, Memorandum from Chief Judge
Ellington to Chapter 13 Trustees for the Southern District of
Mississippi.
For Chapter 13 cases filed before March 1, 2009, the bankruptcy
judges for the Southern District of Mississippi previously
announced a presumptive rate of 9.5% consistent with an order issued by Judge
David W. Houston on May 1, 2008.
