Notice to Creditors Added by Amendment

The debtor must give notice to the affected party when adding a creditor to following schedules or list:

 

  • Schedule D - Creditors Who Have Claims Secured by Property;
  • Schedule E/F- Creditors Who Have Unsecured Claims; or
  • List of Creditors (a/k/a Matrix)

Notice Requirements

 

Chapter 13
 

  • 21 days to request an adjourned 341 (meeting of creditors).

  •  

  • 30 days to object to the plan.

 

  • 30 days from the conclusion of the 341 meeting or from the notice of amendment (whichever is later) to object to the property claimed as exempt.

 

  • 60 days to file a:

    • complaint to determine the dischargeability of a debt under § 523;

    • motion objecting to discharge under  § 1328(f);

    • motion to seek an extension of time for filing a complaint; or

    • motion objecting to discharge
       

  • 70 days to file a proof of claim
     

  • Provide a copy of the Notice of Chapter 13 Bankruptcy Case (Notice scheduling deadlines and meeting of creditors):

    • The notice mailed to the creditor - include the debtor(s) full social security number.

    • The notice filed with the Court  - redact the debtor(s) social security number.

 

  • Certificate of Service

 

Chapter 7 
 

  • 21 days to request an adjourned 341 (meeting of creditors).
     

  • 30 days from the conclusion of the 341 meeting or from the notice of amendment (whichever is later) to file an objection to property claimed as exempt. 

 

  • 60 days to file a:

    • complaint to determine the dischargeability of a debt under § 523;

    • complaint objecting to discharge under § 727;

    • motion objecting to discharge under  § 1328(f);

    • motion to seek an extension of time for filing a complaint; or

    • motion objecting to discharge
       

  • 70 days to file a proof of claim (only asset case)  
     

  • Provide a copy of the Notice of Chapter 7 Bankruptcy Case (Notice scheduling deadlines and meeting of creditors):

    • The notice mailed to the creditor - include the debtor(s) full social security number.

    • The notice filed with the Court  - redact the debtor(s) social security number.
