Consolidated Appropriations Act (Pub. L. 116-260)
On December 27, 2020, the Consolidated Appropriations Act created a (temporary) new section 501(f) in the Bankruptcy Code. This section permits an "eligible creditor" to file a supplemental proof of claim for a CARES Act forbearance claim in a Chapter 13 case.
A new director's form (B 4100S) to file a supplemental claim under the new temporary law is available on the US Court website www.uscourts.gov. The form and law will expire on December 27, 2021.
